Biocube pump

I just setup my first aquarium, a Biocube 29. We filled the tank as directed, but something ain't right with the pump. The directions say DO NOT allow the water level to go above the maximum indicator while running, but it is way above the line even with the pump running. It does empty about a half inch of water out of the pump chamber when I plug it in. Is this pump whacked or am I?

I guess my concern is the big print warning not to allow the water level to go above maximum. What would be the consequences of the water level being high in the pump chamber?
