A few corrections and comments.....
1. There is no law that says builders have to build a home in any specific manner. There are codes.
2. No municipality is "required" to adopt any code however many do.
3. If a municipality requires a certificate of occupancy be issued prior to the building being occupied, certain inspections must be made to ensure that required codes have been satisfied.
4. Almost all builders will build to Minimum Code Standards because exceeding those standards results in higher costs. With higher costs, the end user will go elsewhere.
5. Many codes are written to satisfy certain "trendy issues". Energy consumption is one such issue. As a result, some codes require certain practices without full consideration of trickle down effects. Pretty standard results of regulation authorities in my humble opinion.
My point here is, while the OP has a specific issue he is trying to correct, it may not be reasonable (in this thread) to lay blame at the feet of an industry that is trying to adhere to regulations they did not conceive or enact.
Just my $1.50. (Used to be $.02 but for inflation and all that).
